The Women's Enterprise Development Center Inc. (WEDC) values and respects your privacy. This Privacy Policy applies to WEDC’s website (wedcbiz.org) and describes how WEDC collects and uses information about you. By using WEDC’s website, you expressly consent to WEDC’s collection and use of information about you, as described below.
1. Changes and Updates to This Privacy Policy
WEDC may revise this Privacy Policy from time to time as we expand our online offerings. Please take note of the “Last Updated” date at the top of this page and revisit this Privacy Policy from time to time to stay informed about WEDC’s privacy practices. WEDC will notify registered users of this website via email of any changes to this Privacy Policy that materially expand WEDC’s use or disclosure of information about you.
2. Your Use of the Ning Platform
WEDC’s website is a “Network” offered by Glam Media, Inc. through its Ning.com social media platform.
Please review the Privacy Policy for Ning.com, available at http://www.ning.com/about/legal/privacy/, before using the WEDC site. WEDC has no business relationship with Glam Media and has no control over Glam Media’s privacy practices. All inquiries regarding your account(s) with Ning, if any, should be directed to Glam Media.
You may be able to sign up for an account on WEDC’s website using your Google or Yahoo! account credentials. When you do so, certain information is sent to WEDC to pre-populate fields on our registration form. When you sign in to a registered account on WEDC’s website using your Google or Yahoo! credentials, those credentials will be sent to the relevant company to verify your identity. All inquiries regarding your Google or Yahoo account or the privacy practices of these companies should be directed to Google Inc. or Yahoo! Inc. respectively.
3. The Information That WEDC Collects
Personal Information
When you sign up for an account on WEDC’s website, WEDC requires you to provide your email address and full name, a profile photo, the name and type of your business (if any) and the state where it is located. You are also required to select an option describing your relationship (if any with) WEDC and your business’s Minority- and Women-Owned Business Enterprise (MWBE) certification status. If you sign up with Google or Yahoo! credentials, as described above, WEDC may receive other personal information about you.
You may provide, at a later time, personal information about yourself through the website’s social networking features. You may also provide, during signup or at a later time, other information about your business, including its street address, phone number, email address, website, and a brief description of the business.
As you use the social networking features of WEDC’s website, you may provide one or more photos (in addition to your profile photo) or videos featuring you and/or your business.
When you sign up for our email newsletter, which is offered separately from an account on our website, you provide your email address to WEDC. You also have the option to provide WEDC with your first and last name.
When you donate to WEDC by clicking through to PayPal from our “Get Involved” page, WEDC will receive a report of the transaction but will not receive information about your credit card, bank account, or other financial information. Non-Personal Information
WEDC also collects the following types of non-personal information about your use of our site:
WEDC may maintain server logs that record information about the visitors to our website. This information typically includes data about the version of your web browser, browser plugins, and operating system; your IP address; the date and time of your visit(s) to our site; and records of the information that your browser requested from our servers.
WEDC uses cookies throughout our site to collect information and to enable various features of our site to function. Cookies are small text files stored on your hard drive that store information about your interactions with WEDC’s site and, for example, can allow you to remain logged in to the site, allow you to set preferences in the social media component of our site, and allow WEDC to track your use of features on our site. WEDC may use both “session cookies” (which expire when you close your browser”) and “persistent cookies”, which will last until they expire at a certain date or are deleted by you.
WEDC may from time to time use “pixel tags”, also known as “clear GIFs” or “web beacons”, in conjunction with cookies to monitor both visits to pages on our site and your movement across pages when you are logged in.
4. How WEDC Uses Information about You and Your Business
When you sign up through the Ning platform for an account on WEDC’s website, you create a public profile on WEDC’s Ning Network. Your name, profile photo, business name and type and state, WEDC relationship and MWBE status, and any other information (including photos and videos) that you choose to provide to WEDC will be displayed publicly to all visitors to WEDC’s site.
WEDC provides opportunities for Members to interact with one another and with WEDC staff through Groups, Blog Posts, Comments, Photos and Photo Albums, Videos, Events, Discussions, and other features on our website. Your participation in these site features will be visible to WEDC website Members and generally to any visitor to WEDC’s website.
In the first quarter of 2012, WEDC launched the Business Directory section of our site, which lists businesses founded and/or managed by graduates of WEDC’s Entrepreneurial Training Program and other entrepreneurs. If you submit information about your business to be listed in the Business Directory, such information will be visible to all visitors to WEDC’s website.
5. Our Information Disclosure Practices
As described above, your personal information will be visible to WEDC website Members and other visitors to our site if you choose to sign up for our Ning Network. Please be aware that WEDC cannot control how other persons and businesses use information obtained from your Ning profile or from WEDC’s Marketplace page.
WEDC does not sell, trade, or disclose your personal information to third parties for marketing or promotional purposes.
If you sign up for WEDC’s email newsletter, WEDC will share your email address with Constant Contact, Inc., the company that maintains our email list and sends the newsletters on behalf of WEDC.
WEDC will disclose your personal information where such disclosure is required by law, court orders, law enforcement inquiries, subpoenas, or other legal process.
6. Third-Party Sites and Services
WEDC may from time to time use third-party sites and platforms to deliver videos, announce events, present educational content, or otherwise interact with Members and other visitors to the site. These third parties may include – in addition to the Ning.com platform on which WEDC’s website is built – LinkedIn, Facebook, YouTube, Twitter, and other services. You are solely responsible for reviewing the privacy policies of these third parties. WEDC does not control these third parties and this privacy policy does not apply to third parties’ collection, use, or disclosure of information. WEDC exercises reasonable efforts to select third party services that value and protect your privacy but does not guarantee to you that these third parties will abide by their stated policies.
WEDC maintains a Google Analytics account to track visitors’ use of our site and improve our offerings. Google Analytics uses a small snippet of Javascript on each page of WEDC’s site, as well as cookies set on your PC, to report to WEDC how you interact with our website. WEDC receives reports from Google Analytics but WEDC does not combine this non-personal information reported to us with personal information that you provide to us. As a condition of WEDC’s use of the Ning platform, Glam Media may use its own tracking services or other third-party tracking services on WEDC’s Ning Network. Please review Ning’s Privacy Policy at http://www.ning.com/about/legal/privacy to learn more about how Ning tracks visitors to Networks. Ning’s Privacy Policy may also provide information about Glam Media’s tracking affiliates or vendors, and WEDC encourages you to review the policies of these companies.
7. Children’s Privacy
WEDC does not knowingly collect information about children under the age of 13 through our website. WEDC does not provide services to children. If your child has registered for a Ning account to use WEDC’s website, please notify WEDC and provide us with sufficient information to identify the account so that we may delete any personal information we possess about your child. You should also contact Glam Media Inc. directly to ensure that Ning deletes any personal information Ning may possess as a result of your child’s creation of a Ning account.
8. Data Security
Please keep in mind that WEDC’s website is in large part a social network, and as such many people will have access to the information that you share about yourself.
WEDC uses industry standard security measures to protect your personal information. WEDC uses commercially available technical measures to restrict access to your information and does not allow unauthorized persons to view our databases.
Please note that at this time WEDC is unable to provide a Hypertext Transfer Protocol Secure (HTTPS) connection to the WEDC website because Ning does not currently host security certificates for Networks operating on other domains (e.g. wedcbiz.org). Please exercise caution regarding creating or signing on to your account on the WEDC website from a network that is unfamiliar to you, as your credentials will not be encrypted during transmission. Users who require a secure sign-on process should opt to create and sign in to their WEDC website account using Google or Yahoo! credentials.
The administrator of WEDC’s website has the ability to reset the password for your account on WEDC’s Ning Network in the event that you forget it. You are solely responsible for keeping your password secure and private.
WEDC does not warrant that your data will be protected from unauthorized access, downloading, alteration, disclosure, or destruction. No website or service can guarantee perfect security, and WEDC will not be liable for intrusions or attacks on our website that result in unauthorized use of your data. WEDC is hosted by Ning, and you should review Ning’s security practices at http://www.ning.com/about/legal/privacy/#9. WEDC will use reasonable efforts to notify you by email if we discover that your data has been compromised by a breach of our systems.
9. Your Choices
WEDC is committed to giving you control of the personal information that we collect and use.

To completely remove additional personal information related to your participation in the WEDC Ning network, you may request its deletion from Ning’s servers by emailing privacyinfo [at] ning [dot] com.

WEDC Terms of Use Policy

The following Terms of Use (the “Terms of Use” or the “Terms”) set out a binding agreement between you, personally and as a representative of your business, (“You”) and The Women's Enterprise Development Center Inc. (“WEDC”) regarding your use of WEDC’s website located at http://wedcbiz.org (the “Website” or “WEDC’s website”).
By accessing WEDC’s website or signing up for an account on WEDC’s Ning Network (the “Network”), you agree to comply with these Terms of Use, including as they may be later amended and modified. You thereby represent to WEDC that you are at least eighteen (18) years of age and are otherwise capable of entering into and performing legal agreements. If you access WEDC’s website on behalf of your company or organization, or allow any other party to use your login credentials to do so, you thereby (1) represent to WEDC that you and any such other party have the authority to bind that business or other entity to these Terms of Use and (2) represent to WEDC that your use of the site will be treated as acceptance of these Terms of Use by that entity.
1. Changes and Updates to These Terms of Use
WEDC reserves the right to update these Terms of Use from time to time. You must review these Terms of Use before using the website or signing up for WEDC’s Ning Network, and you should revisit this page periodically thereafter to inform yourself of changes to these Terms. In the event that changes to the Terms of Use materially restrict your use of WEDC’s website, WEDC will use reasonable efforts to inform you by email and in any case will update the Terms of Use section of WEDC’s website to inform users of the changes.
2. Incorporation by Reference
Your use of WEDC’s website is governed by WEDC’s Privacy Policy, available at http://wedcbiz.org/page/privacy-policy. The Privacy Policy is hereby incorporated by reference into these Terms of Use. WEDC’s Privacy Policy may refer to third-party privacy policies to explain your rights and choices with regard to data collection by third parties on WEDC’s website. WEDC’s website is built as a Ning.com Network and relies on capabilities provided by Ning.com to provide a social network and other features to site visitors. Your use of WEDC’s website, like your use of any Ning.com Network, is governed by Ning’s own Terms of Service, and they are hereby incorporated by reference into WEDC’s Terms of Service. 3. Copyright Policy

4. Content Owned By WEDC And Our Limited License To You
As indicated in Ning’s Terms Of Service, Ning is the owner of all right, title, and interest in the technology used in the Ning platform.
WEDC is the owner of all right, title, and interest in all WEDC logos and WEDC-created graphics used on the website. WEDC owns the copyright in all articles, blog posts, comments, and similar text entries posted to the WEDC website by WEDC employees and contractors. WEDC also owns the copyright in all photos and videos posted to the WEDC website by WEDC employees and contractors.
You agree not to use WEDC’s logos or graphics without the advance written permission of WEDC. Misleading uses of WEDC’s logos or graphics to claim or imply an affiliation of your business with WEDC, claim or imply a certain minority- or women-owned business certification status, or to claim or imply that you have completed one or more of WEDC’s course offerings are strictly prohibited.
WEDC is pleased to offer badges (see http://wedcbiz.org/main/embeddable/list), which feature WEDC’s logo and which you may freely use to link back to WEDC’s website. You may not alter the link to WEDC’s website, but you may change the color of the badge background, the color of badge text, and the size of the badge.
Subject to your compliance with WEDC’s Terms of Use, WEDC grants you a limited, non-exclusive, non-transferable, freely revocable license to:
In any dispute under this section as to whether your use of WEDC’s content is misleading or otherwise prohibited, WEDC’s decision shall be final and binding upon you.
5. Content Owned By You and Your Limited License to WEDC
By posting text, images, videos, or other content to WEDC’s website, you grant WEDC a limited, non-exclusive, royalty-free, freely transferable license to publish, reproduce, distribute, publicly perform, modify, create derivative works of, and otherwise use and exploit the content. Revocation of this limited license, if any, by you, shall be through technical means on the Ning platform (e.g., “Delete” buttons or similar available to you as the author).
WEDC is committed to working with our members to resolve conflicts regarding WEDC’s use of content added by you to the WEDC website. While WEDC shall have no obligation to remove your content from display or from our website in a timely fashion, WEDC will exercise reasonable efforts to remove any of your content that you wish to remove, provided (1) such content is not already editable or capable of being deleted in your normal use of the site and (2) removal of such content will not negatively impact the ordinary operation of WEDC’s Ning Network.
6. Prohibited Conduct
In addition to the “Acceptable Use and Conduct policy that binds all Ning users (see http://www.ning.com/about/legal/tos/#def_15), you agree to participate in WEDC’s Network in good faith, under your own name, and without acting contrary to the Mission of WEDC (see http://wedcbiz.org/page/about-wedc).
For the avoidance of doubt, WEDC’s decision in particular cases regarding acceptable use of WEDC’s website shall be final and binding upon you.
7. Termination
You agree that WEDC, in its sole discretion, shall have the right to limit or terminate your account and to delete, modify, or block any content you add to WEDC’s website, for any reason or for no reason at all, without notice to you. WEDC will refer fraud, abuse, and other malicious conduct to the appropriate law enforcement agency and reserves the right to exercise any other remedies WEDC possesses at law or in equity.
Your sole remedy for dissatisfaction with WEDC’s website is to cease all use of the website and to terminate your account on WEDC’s Ning Network.
8. DISCLAIMER OF WARRANTIES
ALL CONTENT ON WEDC’S WEBSITE, INCLUDING CONTENT IN THE BUSINESS DIRECTORY SECTION OF THE WEBSITE, IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY, ON AN “AS IS”, “WITH ALL FAULTS”, AND “AS AVAILABLE” BASIS, AND WEDC DOES NOT GUARANTEE ITS ACCURACY OR COMPLETENESS.
WEDC AND ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND WHATSOEVER TO YOU OR ANY OTHER PERSON RELATING IN ANY WAY TO THE WEDC WEBSITE AND DISCLAIM TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY AND ALL SUCH REPRESENTATIONS AND WARRANTIES.
NONE OF THE ABOVE ENTITIES WARRANTS THAT WEDC’S WEBSITE WILL MEET YOUR NEEDS OR FULFILL ANY SPECIFIC REQUIREMENTS, BE AVAILABLE OR UNINTERRUPTED OR ERROR FREE, OR FREE OF COMPUTER VIRUSES AND OTHER MALICIOUS CODE.
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, WEDC AND ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS DISCLAIM TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY (I) WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; (II) WARRANTIES AGAINST INFRINGEMENT OF ANY THIRD PARTY INTELLECTUAL PROPERTY OR PROPRIETARY RIGHTS; (III) WARRANTIES RELATING TO DELAYS, INTERRUPTIONS, ERRORS, OR OMISSIONS IN WEDC’S WEBSITE, OR ANY PART THEREOF; (IV) WARRANTIES RELATING TO THE TRANSMISSION OR DELIVERY OF WEDC’S WEBSITE; (V) WARRANTIES RELATING TO THE ACCURACY OR CORRECTNESS OF DATA ON THE WEDC WEBSITE; AND (VI) OTHER WARRANTIES RELATING TO PERFORMANCE, NONPERFORMANCE, OR OTHER ACTS OR OMISSIONS OF WEDC AND ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS.

12. LIMITATION OF LIABILITY
IN NO EVENT WILL WEDC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE IN ANY MANNER WHATSOEVER FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF: (I) THE WEDC WEBSITE, YOUR ACCESS, USE OR INABILITY TO USE THE WEBSITE; (II) ANY FAILURE OR PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE (INCLUDING LOSS PROFITS, LOSS OF BUSINESS OR DATA, BUSINESS INTERRUPTION, AND DAMAGES THAT RESULT FROM INACCURACY OF THE INFORMATION OR INCONVENIENCE, DELAY, OR LOSS OF THE USE OF THE WEDC WEBSITE); (III) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE WEDC WEBSITE, (IV) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL IDENTIFIABLE INFORMATION STORED THEREIN, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE WEDC WEBSITE BY ANY THIRD PARTY.
IN NO EVENT WILL WEDC’S OR ITS DIRECTORS’, OFFICERS’, EMPLOYEES’, OR AGENTS’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEDC WEBSITE OR YOUR INTERACTION WITH OTHER WEDC WEBSITE USERS (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO WEDC DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.
WEDC RESERVES THE RIGHT TO ALTER, REMOVE OR DISCONTINUE ANY PORTION OF THE WEDC WEBSITE OR CONTENT ON THE WEDC WEBSITE OR TO SUSPEND OR TERMINATE YOUR USE IN ANY WAY, AT ANY TIME, FOR ANY REASON, WITHOUT PRIOR NOTIFICATION, AND WILL NOT BE LIABLE IN ANY WAY FOR POSSIBLE CONSEQUENCES OF SUCH CHANGES.
THE FOREGOING LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE STRICT LIABILITY OR ANY OTHER BASIS, EVEN IF WEDC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, OR ANY OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THESE LIMITATIONS OF LIABILITY ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY YOU BY REASON OF ANY PRODUCTS OR SERVICES SOLD OR PROVIDED ON ANY THIRD-PARTY SERVICES OR OTHERWISE BY THIRD PARTIES OTHER THAN WEDC AND RECEIVED THROUGH OR ADVERTISED ON THE WEDC WEBSITE OR ANY WEBSITES LINKED THEREFROM.
YOU SPECIFICALLY ACKNOWLEDGE THAT WEDC SHALL NOT BE LIABLE FOR THE CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES, WEDC’S LIABILITY AND THE LIABILITY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
13. No Class Actions
YOU AND WEDC AGREE THAT YOU MAY BRING CLAIMS AGAINST WEDC ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
14. Waiver and Severability
The failure to require performance of any provision of these Terms of Use shall not affect WEDC’s right to require performance at any time thereafter, nor shall a waiver of any breach or default of these Terms of Use constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
If any portion of these Terms of Use is found to be unenforceable, such portion will be modified to reflect the parties’ intention and only to the extent necessary to make it enforceable, and the remaining provisions of this Agreement will remain in full force and effect.
15. Assignment
These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by You, but may be assigned by WEDC without restriction.
16. Choice of Law and Forum
These Terms and Your use of the WEDC’s website shall be governed by the substantive laws of the State of New York without reference to its choice or conflicts of law principles. All disputes arising between You and WEDC under these Terms of Use shall be subject to the exclusive jurisdiction of the state and federal courts located in Westchester County, New York, and you hereby submit to the personal jurisdiction and venue of these courts and waive any jurisdictional, venue or inconvenient forum objections to such courts.
17. Entire Agreement; No Third Party Beneficiaries; No Agency
These Terms, incorporating by reference WEDC’s Privacy Policy and the Terms of Service of Glam Media Inc.’s Ning platform, represent the entire agreement between You and WEDC relating to the subject matter herein and may not be modified except in writing, signed by both parties, or by a change to these Terms or Policies made by WEDC as set forth above.
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by these Terms of Use.
You and WEDC specifically disavow any desire or intention to created a “third party” beneficiary contract, and specifically declare that no person, except for you, WEDC, and WEDC’S assignees, shall have any rights hereunder nor any right of enforcement hereof.
18. Charitable Disclosure Statement and SBA Disclosure
The Women’s Enterprise Development Center Inc. is a tax exempt organization. Your contributions are tax deductible to the extent allowed by law.
